Western Property Management, Inc. strives to ensure a fair distribution of the security deposit between the Landlord and Tenant based on all available information regarding the condition of the property just prior to the move-in and just after the move-out. We recognize that there may be situations where you have additional information that we initially did not take into account.
The purpose of the this final review is to make sure that you have the opportunity to provide additional information when you are not satisfied with the rationale for the return or withholding of your security deposit funds. Once this form is submitted, our review committee will objectively review all information, including your comments, solicit any additional information and/or approval from the Landlord and make any appropriate adjustments. The process will follow the following steps:
- Submission of the Request for Final Review of Security Deposit (by you) within 10 days of receipt of security deposit disposition.
- Review Committee will re-assess based on all available information including your account.
- Within 14 days of the submission date, you will be notified via- US mail of the Committees findings along with any adjustments or explanations.
If there are any adjustments to the deposit based on the findings you will receive a Security Deposit Review Response and Agreement and then either a check or possibly an invoice for additional amounts owed.
All parties agree that no formal complaints or legal action have been or will be initiated with any professional agencies or court system. This agreement constitutes a compromise of disputed claims, the liability of which is expressly denied. Nothing in this agreement constitutes or shall be construed as an admission of liability by either party. All parties including Landlord hereby release and forever discharge each other from any and all claims, demands, rights and causes of action of whatsoever kind and nature arising from the lease agreement.
The tenant agrees to not disparage or defame in any respect or to make any derogatory comments, whether written or oral, of Western Property Management, Inc. or its employees. The facts of the dispute and terms of this agreement are confidential for a period of no less than 3 years. Any violation of this agreement may result in legal action against violating party which would then be responsible for legal fees in addition to other damages.
